 The different steps in a legal lawsuit in Spain.

They vary according to the kind of procedure, but in general terms, they all start by filing a petition at court which is called “a statement of case”. The statement of case is sent to the other party for them to answer (if they so wish) within a certain period of time.

Depending on the case, a prior hearing at the Spanish court will normally be held to settle the facts of the litigation, to resolve any technical issues and present the evidence that both parties have agreed upon.

There’s always an oral trial in which the judge is present, the evidence is presented and the closing arguments are made.

Several weeks after, the judge will pass sentence either in favour of one or the other party. There is the possibility to appeal against the majority of the judgments, but the prevailing party may request the judgement to be executed provisionally. Therefore, it is not necessary to wait until the end of the procedure to collect the amount the other party owes you.
