Should I go to a Spanish court? Spanish litigation firm provides you the answer
The Spanish property and litigation Lawyers of Arcos & Lamers Asociados sincerely hope to inform you that there is no need to go to court. Our English spoken solicitors and lawyers always make all efforts to avoid court hearings. We assess our clients’ needs in such a way that we are normally able to reach a clear and firm agreement on their issues so that no further conflict is caused.
However, we need to be realistic. Even the most suitable contract drawn up may not be fulfilled to the full extent if any of the parties do not want to or simply cannot comply. Unfortunately, this occurs more often than we would hope and in some cases, going to court is not only the best solution – sometimes it is the only solution and in those cases we must face up to the situation.
Of course, the lawyers of Arcos & Lamers Asociados will be at your side at all times during the procedure.
Our Spanish litigation department
This department is made up of a team of specialized professionals in different branches of Spanish law: civil, commercial, administrative and labour law. They are excellent lawyers that dedicate many hours to their work to ensure that their knowledge is kept up to date and for this reason, they are able to maintain the level of excellence. We can satisfactorily say that they are among the best in their speciality.
However, this is not what makes them different from other good lawyers. What we really care about is that the lawyers of our Spanish law firm have a true vocation to defend their clients, so they feel that they can trust their lawyer and have absolute confidence in them. And for our lawyers it is a personal proud to find the best solution. They spare no efforts to achieve their goals.
The litigation process is difficult; it is a long journey full of stressful moments before eventually reaching your victory. If you see yourself obliged to go through that procedure, you will obviously wish for the best possible lawyer to assist you: and that’s us, here at Arcos & Lamers.
The different steps in a legal lawsuit in Spain.
They vary according to the kind of procedure, but in general terms, they all start by filing a petition at court which is called “a statement of case”. The statement of case is sent to the other party for them to answer (if they so wish) within a certain period of time.
Depending on the case, a prior hearing at the Spanish court will normally be held to settle the facts of the litigation, to resolve any technical issues and present the evidence that both parties have agreed upon.
There’s always an oral trial in which the judge is present, the evidence is presented and the closing arguments are made.
Several weeks after, the judge will pass sentence either in favour of one or the other party. There is the possibility to appeal against the majority of the judgments, but the prevailing party may request the judgement to be executed provisionally. Therefore, it is not necessary to wait until the end of the procedure to collect the amount the other party owes you.
