The accountants and fiscal advisers of Arcos & Lamers Asociados are pleased to inform you that the Spanish Council of Ministers recently approved to send the Bill to boost e-invoices and set up an accounting register to Parliament. This will allow to put an end to unpaid invoices of suppliers and will expedite payment procedures.

With this future Spanish law, it is expected to reach the following objectives:

 

  • To boost the use of e-invoices both in the public and private sector.
  • Suppliers will be more protected in their commercial relations with the Public Administration.
  • The Administration will have a major control of the invoices in relation to their accountancy.

It is expected that the implementation of the e-invoices will lead to an annual net savings of 51 million compared to the 2.3 million of savings when dealing with the usual invoices on paper.

What does this mean for suppliers?

Suppliers will present the invoices in a digital way on a general access site for e-invoices that each Government must possess.

This will reinforce the protection of suppliers because in this way, they can give proof of the date of the invoice for the purposes of interest in case of delay in the payments of the invoices. This will also expedite the invoices procedures and will make any follow-up easier.

All invoices will have a structured format which has not been determined yet.

As from 15th January 2015, the e-invoice will be obligatory for those persons or entities that are obliged to the digital taxation system in accordance with the current tax regulation.

Nevertheless, Spanish Public Administrations may exclude from this obligation all invoices for an amount of less than five thousand Euros.

On the 3rd of December 2010 it was published at the Official Spanish State Gazette the RD Law 13/2010 which modified the previous Law 3/1993 stating that the membership to the Chamber of Commerce will be voluntary and therefore also its fees.

It was published by the Chamber of Commerce that there would be a transitional period of two years during which the businesses remained subject to the fulfilment of the tax obligation with the Chamber, and according to the rules in forced; the Chamber will keep its legal obligation to collect the fees.

Finally, 2012 should be the last year where the membership should be compulsory for all self-employed entrepreneurs and businesses and this will have the right to stop being members. This move, on the other hand will favour that the Chamber of Commerce will improve to keep its members by providing them with stronger support.

The wealth tax in Spain was introduced for the first time in 1978 as by law 50/1977, of 14 November. The same was introduced as urgent measurement for a fiscal reform (B.O.E. of 16 November), developed by the Spanish Ministerial order of 14 January 1978 (BOE 17 January) that established the wealth tax for individuals (IEPPF) had an extraordinary status. Spain was on his initial steps of democracy and the existence of a progressive tax system had to be proven.

Initially this wealth tax was not introduced for collecting additional taxes only as a high minimum asset value was exempt (4.000.000 pesetas of the time) and, in addition, there was a relevant overall reduction (6 M de pesetas). The tax rate was relatively small, with a maximum of 2%. The target of this Spanish Wealth Tax was basically for controlling Spanish assets purposes being this complementary to the Spanish Income tax. In fact, as mentioned by statistics, few people were declaring, in those times, this tax in Spain.

Spanish  Inland RevenueIn addition, this initial wealth tax had a extraordinary character. It took many years that this “extraordinary status” was taken away.

The first important change occurred in 1988, introduced by the changes at the personal income tax to suit the requirement of individual taxation established by judgement of the Spanish Constitutional Court (S.T.C. No. 45/1989, of 20 February).

With the amendments of Spanish personal income tax in 1991 also appeared a change in the wealth tax, Spanish law 19/1991 of June 6, (BOE, June 7), a set of relevant amendments on previous regulations, some related to the incorporated in the law 18/1991, concerning the Spanish income tax as well as the individualization of the same.

And so we came up to year 2007, which was the last in which this tax was paid in present times. Spain lived a time of rapid and sustained economic growth.. Starting financial year 2008, the Spanish wealth tax was not “deleted” but a bonus of 100% was introduced in the Law. Meaning this that no wealth tax had to be declared any more. This drastic change was mainly introduced as by the pressures from what was happening in the European tax environment.

Nevertheless, the economic crisis and the lack of funds of the Spanish Inland Revenue, reactivated the wealth tax from exercise 2011 (payable in 2012), although it was promised by law that this tax would only affect the fiscal years 2011 and 2012 (Single article Royal Decree-Law 13/2011 of September 16,2011) that was reinforcing the wealth tax in Spain.

In this situation we find ourselves in today, but all indications are that these promises will turn into false by adjustments to be carried out and, apparently, the Presupuestos Generales del Estado ( The Spanish State General Budgets) for 2013, which just arrived at the Spanish Parliament the past 29 September, extended the wealth tax, who knows if even for future periods.

Elections in Galicia, Spain. Spanish elections.

The conservative party of Spanish Prime Minister Mariano Rajoy has hailed the result of electoral victory in the north-western region of Galicia as an endorsement of its national austerity programme.

 The People’s Party increased its majority in the Galician assembly in regional elections on Sunday that had been billed as a referendum on the government’s first 11 months in office during which it introduced stringent austerity measures, tax hikes and public sector cuts.

“The steps, that we have explained had to be taken to resolve the crisis, have had overwhelming support,” Carlos Floriano, the party campaign chief claimed in an interview with state radio, Monday. “There is no precedent in this crisis situation of a government not just defending but actually increasing its majority.”

The PP won 41 of the 75 seats in Galicia’s regional parliament, increasing its absolute majority by three, as voters in the region failed to punish the ruling party despite unpopular measures to combat the crisis that have seen street protests increase across Spain and a second general strike called for next month.

The regional result is widely seen as having bought Mr Rajoy breathing space as he continues to mull whether to request a full Spanish sovereign bail-out from Europe in the face of German opposition.

Analysts believe Mr Rajoy had delayed making such a request ahead of the electoral test, fearing that strict conditions imposed on Spain, including unpopular pension reforms, would be viewed badly by the electorate.

But with such an obstacle now cleared, expectations are growing that a bail-out request will come sooner rather than later.

“Now (Rajoy) has the support of his region, perhaps he’ll feel confident to actually press forward and ask for a bailout,” said Fiona Cincotta, City Index market strategist.
Markets had been patient in the run up to the weekend vote in Galicia, she said, but will want to see action on a bailout request soon.

Spanish 10-year bond yields crept up 5 basis points in the wake of the election result to 5.43pc, having fallen around half a point last week after the country retained its investment grade rating.

A research institute linked to Spain’s employers lobby also called for a quick decision. “Spain should accept conditions by the ECB and other European authorities and the sooner the better,” Jose Luis Feito, chairman of the IEE said Monday. “The longer we wait, the more difficult and drastic it will be.”

The announcement is good news for the estimated 100,000 British pensioners who live in Spain, many of whom are not able to claim the allowance under current laws.

Previously, elderly expats could only receive the payment if they turned 60 before leaving Britain and if they had left after the payment was introduced in 1998.

But expats now only need to have a ‘genuine and sufficient link to the UK’ to qualify, including having ‘lived or worked in the UK for most of your working life’.

The ruling by the European Court of Justice affects around 440,000 elderly Britons who live outside Britain but within the EU.

Anyone born on or before July 5, 1951, can now make a claim for the payment this year, which ranges from £200 to £300 depending on your circumstances.

In the 2010-11 winter, 72,840 expats claimed winter fuel payments, at a cost of almost £16 million – a figure which could rise to £100 million if all of the eligible expats were to claim it.

Work and Pensions Secretary Iain Duncan Smith called the ruling ‘ludicrous’ and has promised to introduce a ‘temperature test’ to determine eligibility.
