It is located close to nine of the Costa del Sol’s famous golf courses including La Zagaleta, Montemayor, Alqueria, Los Flamingos and theMarbella ClubGolf Resort.

Breathtaking views stretch across the countryside to the Mediterranean with its granite sands and in the distance the enchanting Moroccan coastline.

The history of Benahavis starts at the end of the XIth century.  It was initially known as Montemayor Castle, which played a very important role in the battles between the various Arab kings in Andalucia.  It was formed for its strategic position, and disputed for many years by the military factions of the epoch.  Its prominent location overlooking up to a hundred kilometers of seaboard, and even the African coast, was extremely useful at a time when piracy and invasion were commonplace.

The town takes its name from Havis, who reigned in Montemayor Castle, to be precise, Benahavis means son of Havis”.  The castle’s strategic location drew the attention of the Catholic Monarchs, intent on conquering the last Moorish kingdoms in the south of the Iberian Peninsula, Isabel and Ferdinand´s forces had already laid siege to the Nazarite kingdom of Granada, but they decided first to occupy the nearby province of Malaga.

On the 11th of June 1485, Benahavis, together with the 8 localities of the Bermeja Mountains, all within the district of Marbella, were handed over to King Ferdinand the Catholic, by Mohammed Abuneza after the signing of the capitulation.

The Catholic King entrusted their custody to Don Pedro Villandrado, Count of Ribadeo, and the first Christian mayor of Benahavis.  From that moment on, a dispute arose between Benahavis and Marbella which lasted three and half centuries, until Benahavis achieved the status of a completely independent community.

Stuck in a time warp it features winding cobbled streets, lined with orange trees, its wonderful buildings reminiscent of its ancient Moorish heritage seem like a specially created film set.  A population of less than 2,000 residents offer a friendly welcome and range of supporting services which ensure your stay is heavenly.

Many people live in more than one country during a tax year (e.g. Spain plus another country). Furthermore, they could own several properties in both countries.

In order to determine your tax liabilities you need to clearly state the country of residence for tax purposes.

When you are considered to be a Spanish Fiscal Resident you will be liable to be taxed for all your Wealth and Income, obtained not only in Spain but World wide, according to Spanish Tax rules and rates – this will include all pension funds unless stated otherwise.

In order to determine your Residency the Spanish Inland Revenue states that:

Any person will be considered a Spanish resident as long as one or more of the following circumstances are met.

  1. That the person remains more than 183 days during the calendar year on Spanish Territory.  In order to determine the residency period under Spanish Territory sporadic absences will be included as well, unless the person can certify his Fiscal Residency abroad.  In the event that the countries or territory was considered to be an Off-Shore country or territory then the Spanish Inland Revenue can request proof of permanency in that country for more than 183 days.
  2. That Spain is the main centre or base of their activities or economical interest directly or indirectly.
  3. That the spouse, not legally separated, together with any under age children dependant on this person are usually resident in Spain.

The condition of Spanish tax payers in concept to the Income Tax Return will not be lost by any person holding a Spanish Nationality that changes his Fiscal residency to a country considered an Off-Shore country or territory.  This rule will be applicable to the tax year where the change took place plus the following four years.

On the other hand, a person will be considered non resident in Spain when they do not meet any of the requirements mentioned above.

The controversial two-phase overhaul will involve a new tax regime for the industry, followed by a shake up of the energy market.

The financial crisis has forced the government into making €65 billion of cuts, €8.6 billion of which will come from new energy and environmental taxes within the next three years.

Among the reforms being considered is a tax on the purchase of natural gas, although any such tariff would not be introduced until 2013.

Under current legislation, energy companies cannot charge consumers above a certain threshold, which is not high enough to cover their costs.

This has created a €24 billion tariff deficit which the government has so far had to compensate through subsidies.

The plans have caused friction between the treasury and industry ministers over how the reforms will be implemented, while energy firms Iberdrola, Endesa and Gas Natural claim the plans will wipe out their profits.

The announcement is good news for the estimated 100,000 British pensioners who live in Spain, many of whom are not able to claim the allowance under current laws.

Previously, elderly expats could only receive the payment if they turned 60 before leaving Britain and if they had left after the payment was introduced in 1998.

But expats now only need to have a ‘genuine and sufficient link to the UK’ to qualify, including having ‘lived or worked in the UK for most of your working life’.

The ruling by the European Court of Justice affects around 440,000 elderly Britons who live outside Britain but within the EU.

Anyone born on or before July 5, 1951, can now make a claim for the payment this year, which ranges from £200 to £300 depending on your circumstances.

In the 2010-11 winter, 72,840 expats claimed winter fuel payments, at a cost of almost £16 million – a figure which could rise to £100 million if all of the eligible expats were to claim it.

Work and Pensions Secretary Iain Duncan Smith called the ruling ‘ludicrous’ and has promised to introduce a ‘temperature test’ to determine eligibility.

In his speech at the closing ceremony, Mariano Rajoy underlined the importance of the trade and investment ties that exist between Spain and Germany.

In his opinion, the strong bilateral ties between the two countries can only be explained by the integration process being enjoyed in Europe. “The Euro has facilitated economic and financial integration, and both Spain and Germany have benefitted in particular from that”, said the President of the Government.

However, he pointed out that, despite notable benefits in terms of stability, prosperity and peace, the European integration process is going through a time of uncertainty and mistrust, which is affecting growth perspectives in Europe.

For this reason, he explained, “it is our responsibility to guarantee that the integration process continues in a decisive manner”. The Spanish and German Governments are firmly committed to that.

“The path to follow at this time of uncertainty can only be one of strengthening European structures”.

The President of the Government referred to the difficult economic situation in Spain and assured that the government is determined to overcome it. “That is my determination and that is my commitment”, he said.

Mariano Rajoy acknowledged the problems that this represents against a backdrop of turbulence and growing difficulties in gaining access to financing. “However, there is no other way forward”. His conviction is that these efforts will not be in vain and that they will lay the foundations for a more stable and prosperous future.

In his opinion, we need to act on various fronts: at a fiscal and financial level, through greater economic integration and a decisive reform policy, since only through these reforms at both a domestic and European level will we be able to place both the Spanish economy and the European economy in a position to compete and grow; and their companies in a condition to take advantage of existing opportunities.

A strong Europe

In her speech, Angela Merkel highlighted that “we have a common interest, the common interest of being a strong Europe because we feel proud of living how we do and because we want to guarantee that our children and grandchildren can also do so”.

In relation to the crisis being suffered in the European Union, the German Chancellor expressed her conviction that “we all have to escape from this trap together”, since 80 million Germans cannot do much by themselves. In her opinion, it is necessary that “all 500 million Europeans join together to defend our interests from within as one unit”.

Angela Merkel underlined that “we all have to make reforms in our own countries and what is hard in Spain at the moment is that the reforms are not having an immediate effect but rather it will have to run its course for a good while” before seeing the effects.

The representative of the Al-Thani Group, Moayad Shatat, has assured the Mayor, Ángeles Muñoz, that the port is a priority project for the company, Nasir Ben Abdullah and Sons. 

There is still no starting date for the construction work, but the environment department of the Junta de Andalucía has undertaken to have a report on the effects of coast shortly.

The project will finally be in the hands of the Junta for its revision.

The surprise announcement on Friday for the new theme parks to be constructed next to the current Port Aventura resort comes after unofficial reports surfaced this week that Las Vegas Sands CEO Sheldon Adelson has finally decided to take his EuroVegas project to Madrid instead of Barcelona.

Spanish billionaire Enrique Banuelos and his Veremonte firm said they will construct the so-called “Barcelona World” on 1.5 million square meters of land belonging to La Caixa in Tarragona province. The 4.5-billion-euro investment is expected to create 20,000 direct jobs.

The parks will be used to recreate six areas of the world: Europe, the United States, Russia, China, Brazil and India. Six hotels, with 2,000 rooms each, will also be built at each park.

The project will be self-financed by investors from the six global areas who want to set up businesses in their respective theme parks, explained Lluís Rollán, of Mediterranean Beach and Golf, a Veremonte affiliate.

The Las Vegas Sands company said this week that no final decision has been made on where to build its massive EuroVegas casino and hotel site. But news that Madrid had already been selected was first announced earlier this week by Madrid Socialist Party (PSM) leader Tomás Gómez, who said that regional premier Esperanza Aguirre of the Popular Party (PP) had secured the bid. Gómez, who has opposed the project, said that EuroVegas will be built in the Madrid suburb of Alcorcón.

For her part, Aguirre neither denied nor confirmed the report but said that her “intuition never fails her,” and that she feels “positive” that Madrid will be selected.

Catalonia’s regional premier Artur Mas on Thursday said that his government’s offer to Aldelson had expired on August 31, and that his administration was now free to do whatever it wanted with the pre-agreement proposal, including modifying the terms or looking for “other alternatives,” which he did not specify. The following day Barcelona World was announced.

Euphoria reigned at the Palau auditorium, where the presentation was held. Representatives from the Catalan government and la Caixa also took part.

“We are not worried about EuroVegas. In fact others should be worried about what we are planning,” said Catalan land commissioner Lluís Recoder, who suggested that Barcelona World will be completed before the EuroVegas project gets off the ground in Madrid.

“Competition is competition and we want to be the first,” said economic commissioner Andreu Mas-Colell.

Adelson has told Catalan officials that the initial investment for EuroVegas would be around 17 billion euros but he also tossed around a 27-billion-euro figure in Madrid. The offer was to build the mega casino-hotel complex on 800 square meters of land near Baix Llogregat, with 250,000 direct and indirect jobs up until 2025.
