Designation of a spanish fiscal representative

According to a recent amendment of Spanish General Tax Law (Ley General Tributaria 58/2003) of 17th December 2003, Spanish Inland Revenue is presently requesting to non-residents inSpain, when operating through a permanent establishment or taking into account the characteristics of the assets they own in Spanish territory, to appoint and designate a Spanish Fiscal – Tax Representative. The fiscal representation should be carried out by a Spanish resident, and as per common practice by a Lawyer or Registered Accountant in Spain. As per the opinion of the Spanish Accountants, lawyers and other professionals of  Arcos & Lamers Asociados, the main reason behind, in making compulsory to appoint a fiscal representative in Spain, would be to guarantee that your Spanish tax obligations are fulfilled.

Spanish lawyers informing on Spanish Capital Gain Tax reduction!

Arcos & Lamers Asociados, Your Spanish Law firm has the pleasure to inform you that the Spanish Government has approved on Friday 11th May 2012 several  measures to stimulate the Spanish property market, including a tax a exemption of 50 per cent on Spanish Capital Gain Tax that could appear out of the potential sale of properties to be acquired in Spain during the rest of the year 2012.

“It is going to be implemented an exemption of 50 per cent of revenues arising from the sale of real estate that are acquired from 11th May to 31st December, provided that there is no link between the parties,” said the Minister of Development, Ana Pastor, in a press conference after the Council of Ministers.


The Spanish Government is proposing limitations on cash payments. According to a proposed draft bill it is expected that part of the Spanish Tax Law (anteproyecto de ley de modificación de la normativita tributaria y presupuestaia y de aduaciación de la normativa financiera para la intensificación de las actuaciones en la prevención y lucha contra el fraude) will be once more amended in the nearest future mentioning that transactions above 2.500,00 Euros can not be paid in cash when one of the parties involved is acting as a company or professional.
